Effective Upon Registration
This Affiliate Agreement (“Agreement”) is entered into by and between you (“Affiliate”) and Pitbull Trader Funding LLC (“Pitbull Traders,” “we,” “our,” or “us”). By joining the Pitbull Traders affiliate program, you agree to the following terms and conditions:
1. Commission Structure
Affiliates earn a commission based on the total referred evaluation sales:
Bronze ($0–$5,000): 10% commission
Silver ($5,001–$10,000): 15% commission
Gold ($10,001–$15,000): 20% commission + 2 free $50,000 evaluations
Diamond ($15,001+): 25% commission + 3 free $150,000 evaluations
Commission tiers are based on lifetime referred revenue. Bonuses are issued monthly once a tier is reached.
2. Payouts
- Commissions are paid via ACH or Wise
- Payments are processed monthly
- Minimum payout threshold is $100
- Affiliates are responsible for providing accurate payout information
3. Marketing and Communications Compliance
To protect Pitbull Traders and its Affiliates from regulatory risks, the following requirements apply to all affiliate marketing, communications, and promotional content:
- Compliance with Laws: Affiliates must comply with all applicable laws, regulations, and industry standards in marketing and advertising.
- Truthful Content: Affiliates may not make false, misleading, or unsubstantiated claims. Guarantees of profits, success, or ease of trading are strictly prohibited. All promotional statements must include balanced discussions of potential risks and rewards.
- Educational Purpose Only: Content provided by affiliates must clearly be informational and educational only and must not constitute investment or trading advice. Affiliates shall not provide personalized trading recommendations or advice.
- Mandatory Risk Disclosure: All promotional materials must prominently feature the following risk disclosure:
“Trading futures and other leveraged instruments involves significant risk of loss and is not suitable for all investors. Only risk capital (funds you can afford to lose) should be used, and you could lose more than your initial investment. Past performance is not necessarily indicative of future results.”
- Hypothetical Performance: Affiliates using hypothetical or simulated trading results must clearly label them as “HYPOTHETICAL” or “SIMULATED” and include the following prominent disclosure:
“Hypothetical performance results have inherent limitations. Unlike actual performance records, simulated results do not represent real trading, and no representation is being made that any account will or is likely to achieve profits or losses similar to those shown.”
- Past Performance Disclosures: Affiliates citing actual past trading results must clearly disclose that “past performance is not necessarily indicative of future results.” Performance claims must be accurate, representative, and net of fees.
- Testimonials: Testimonials or endorsements used by affiliates must clearly state that individual results may vary and are not indicative of future success. Affiliates must disclose clearly if the testimonial provider received compensation or incentives.
- No Implication of Regulatory Oversight: Affiliates must not imply that Pitbull Traders is registered with, regulated by, or endorsed by any regulatory body including the CFTC or NFA.
- Branding Restrictions: Affiliates must not represent themselves as employees, partners, or official representatives of Pitbull Traders. Pitbull Traders branding should not imply partnership or agency.
- Accurate Program Descriptions: Affiliates must accurately describe Pitbull Traders’ programs, clearly indicating that the trading evaluations are simulated and difficult, and success rates must be portrayed accurately.
- Compliance Monitoring: Pitbull Traders reserves the right to monitor, review, and require changes to affiliate-produced content. Affiliates must promptly edit or remove content flagged as non-compliant.
Violation of any of these marketing and communication requirements will be considered a breach of this Agreement, subjecting affiliates to possible termination.
4. Non-Exclusivity
This agreement is non-exclusive. Affiliates may promote other programs or firms, provided they do not misuse Pitbull Traders’ materials or engage in deceptive practices.
5. Termination
Pitbull Traders may terminate this Agreement at any time for violation of these terms, misuse of the brand, or fraudulent behavior. Affiliates may terminate participation at any time by written notice. Earned, compliant commissions will be honored upon termination.
6. Liability & Indemnity
Pitbull Traders is not liable for any legal claims or losses resulting from Affiliate promotions. Affiliates agree to indemnify and hold harmless Pitbull Traders against any claim arising from their marketing activities.
7. Electronic Consent
By registering and clicking “I AGREE,” you consent to enter into this Agreement electronically. This Agreement is binding and enforceable as a signed legal contract.
