DISCLAIMER AND RISK DISCLOSURES
Permitted Products & Purpose
At Pitbull Trader Funding LLC (“Pitbull Trader”), our mission is to empower traders to sharpen their skills in the fast-paced world of futures trading. Our programs provide access to a wide range of futures products exclusively listed on major U.S. exchanges including CME, COMEX, NYMEX, and CBOT. We do not offer trading in stocks, options, forex, cryptocurrencies, or Contracts for Difference (CFDs).
Evaluation Program Disclosure
The Pitbull Trader evaluation is designed to simulate real market conditions and test a trader’s discipline, risk management, and profitability under pressure. This challenge is intentionally difficult. Between January 1, 2024, and December 31, 2024, 17.24% of traders successfully completed the evaluation and advanced to a funded trading account. This program is recommended for individuals with prior trading experience and a solid understanding of futures markets. Many experienced traders still find it challenging.
Informational Use Only
All content and materials provided by Pitbull Trader, including those on our website, social media channels, and any affiliated platforms, are for informational and educational purposes only. None of the content or materials provided by Pitbull Trader should be interpreted as:
- Investment or trading advice;
- A recommendation to buy or sell any financial instrument;
- An offer or solicitation of any kind; or
- An endorsement of any company, product, or strategy.
You are responsible for your use of any information provided by our firm. Pitbull Trader and its affiliates, agents, partners, and employees assume no responsibility for decisions made based on our educational materials and disclaim all liability for losses or damages resulting from reliance on such information. Always consult a qualified financial advisor before making trading or investment decisions.
Hypothetical Performance Results
Any performance results presented by our firm that are hypothetical or based on simulated trading do not represent actual trading. Hypothetical performance results have inherent limitations. Because the trades were not actually executed, such results may under- or over-compensate for the impact of certain market factors (e.g., lack of liquidity). Simulated trading programs are designed with hindsight; no representation is made that any account will or is likely to achieve profits or losses similar to those shown. This cautionary statement is required under CFTC Rule 4.41(b) and NFA Compliance Rule 2-29(c) whenever simulated or hypothetical results are used in promotional material. In line with NFA guidance, we display this disclaimer prominently and in close proximity to any hypothetical performance to ensure it is not overlooked.
Testimonials and Endorsements
Testimonials: If our marketing contains any testimonial or endorsement from a client or trader, please be aware of the following required disclosures:
- NOT TYPICAL: The testimonial may not be representative of the experience of other clients or users. In other words, results or experiences described in a testimonial are not necessarily typical for all traders.
- NO GUARANTEE OF FUTURE RESULTS: The testimonial is not a guarantee of future performance or success. Past or current results achieved by any individual do not ensure that you will achieve similar outcomes.
- DISCLOSURE OF COMPENSATION: If a testimonial is given in exchange for more than nominal compensation (for example, if the person providing it was paid or received other incentives), we will prominently disclose that it is a paid testimonial. (If no such disclosure is made, you may assume no material compensation was paid for the endorsement.)
These disclosures are in accordance with CFTC Rule 4.41(a)(3) and NFA Compliance Rule 2-29(b)(6), which govern the use of testimonials in commodity futures promotional materials. We ensure any testimonial used in our advertising includes clear notice that the experience described may not apply to others and that there is no promise of future success.
General Risk Disclosure
TRADING FUTURES, FOREX, AND OTHER FINANCIAL INSTRUMENTS INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS. WHERE THERE IS THE POTENTIAL FOR PROFIT, THERE IS ALSO THE POTENTIAL FOR LOSS. AN INVESTOR COULD LOSE ALL OR MORE THAN THE INITIAL INVESTMENT. ONLY RISK CAPITAL, MONEY ONE CAN AFFORD TO LOSE WITHOUT JEOPARDIZING FINANCIAL SECURITY, SHOULD BE USED FOR TRADING. PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. NO TRADING STRATEGY, WHETHER BASED ON SIMULATED RESULTS OR ACTUAL PAST PERFORMANCE, CAN GUARANTEE FUTURE OUTCOMES. YOU SHOULD CAREFULLY CONSIDER YOUR OBJECTIVES, EXPERIENCE LEVEL, AND RISK TOLERANCE BEFORE PARTICIPATING IN ANY TRADING PROGRAM.
No Advice or Solicitation: All information and content provided by our firm is for educational and general informational purposes only. Nothing on our website or in our program materials is intended as investment advice or a solicitation to buy or sell any commodity interest, security, or financial instrument. We do not make recommendations or endorsements of any trading strategy or any particular transaction. Participation in our simulated trading program should not be construed as an offer to open a live trading account or to invest with our firm. Any examples of trades, strategies, or performances are solely for illustration and education. Always consult with a qualified financial advisor or consider your own financial circumstances before making actual investment decisions.
Proprietary Trading Program & Regulatory Status
Not Registered with CFTC/NFA: Pitbull Trader Funding, LLC operates as a proprietary trading firm offering a simulated trading evaluation program with the possibility of funding successful traders with proprietary capital. We are not registered with the U.S. Commodity Futures Trading Commission (CFTC) as a futures commission merchant, introducing broker, commodity trading advisor, commodity pool operator, or in any other capacity, and we are not a member of the National Futures Association (NFA). Our services involve evaluating traders on simulated accounts; we do not solicit or accept customer orders for real trades and do not handle client funds in a brokerage capacity. Because we do not provide individualized commodity trading advice to others for compensation (outside of the simulation and evaluation context), we are not required to register as a CTA or to be NFA members under current regulations.
Compliance with Advertising Standards: Even though Pitbull Trader Funding, LLC is not a registered entity, we try to adhere to the CFTC and NFA advertising and disclosure standards as a matter of best practice and transparency. CFTC Rule 4.41 (which governs advertising by commodity trading advisors and others) applies to all persons who engage in commodity interest advertising, regardless of registration status. In keeping with this rule and NFA guidance, we include all necessary risk disclosures, hypothetical performance disclaimers, and testimonial disclaimers in our public materials. By voluntarily following NFA Compliance Rule 2-29 and related Interpretive Notices on promotional material, we aim to ensure that our communications with the public meet the same standards of honesty and clarity expected of regulated firms.
No Government Endorsement: Being not registered and not regulated by the CFTC or NFA means that our program is not subject to their oversight or review. However, this should not be interpreted as any form of endorsement by regulatory authorities. Customers and participants are encouraged to familiarize themselves with industry rules and understand that no regulatory agency has passed upon the merits of our trading program or the completeness of our disclosures. We provide extensive disclaimers (as outlined above) in alignment with CFTC Rule 4.41(b) and NFA’s requirements to ensure you have a clear understanding of the limitations and risks before participating.
By using our website or participating in our simulation program, you acknowledge that you have read and understood the above disclaimers. These disclosures are made to inform you of the risks and limitations inherent in simulated trading and to comply with applicable regulatory guidance (such as CFTC Rule 4.41 and NFA promotional material rules) on how performance and client experiences may be presented. Always trade responsibly and understand that no form of trading is without risk.
